Terms & Conditions

1. Definitions
" Buyer" Means the Customer.
" Seller" FigaroSpares.
com
" Goods" Means the articles or things described in the Order.
" Order" Means the Order placed by the Buyer for the supply of the Goods.

2. Buyer's Order
These terms and conditions apply to all contracts of sale by the Seller unless varied in writing by authorised representatives of the parties. The placing of an order for goods shall be deemed to be acceptance of these conditions. Nothing in these Terms & Conditions shall be construed as affecting the statutory rights of the Customer.

3. Conditions of Goods
The goods shall conform as to quantity, quality and description in the case of a written Order with the particulars stated in the Order, and in the case of a verbal Order, with the particulars noted by the Seller at the time the Order is placed. It shall be the duty of the Buyer to check that an accurate note is taken in these circumstances.

4. Payment
Payment must be made by an accepted method and cleared prior to the delivery of the Goods

5. Delivery and acceptance of delivery
a) Delivery
Suggested delivery dates and promises of delivery are made in good faith and every effort will be made to keep to delivery dates given but time and place of delivery shall not be the essence of this contract and the Seller shall not be liable for any loss caused through delay or failure to deliver.
b) Acceptance of Delivery
If the Buyer fails to take delivery of the goods or any part thereof at the time agreed for delivery then the Seller shall be entitled to cancel or suspend such delivery and all other outstanding deliveries and to charge the Buyer with loss suffered.

6. Delivery areas
We only deliver to mainland Great Britain at this time. Although we occasionally ship orders overseas you should contact us first before attempting to order if you live outside Great Britain mainland.
there will be a charge of £10.99 for delivery & packaging. Orders for Northern Ireland, the Channel or Shetland Islands will be subject to a further handling charge which will not feature on the summary at the checkout. In the majority of cases, we are able to ship via post to these areas for the same cost as the courier charge, although obviously your order may take a little longer to arrive. In the unlikely event that the cost of shipping will be more than this we will email the details of the charge to you and get your approval before sending the goods.
We endeavour to ship all orders (subject to stock availability) the same day as we receive them on a Monday through to Friday, although that does rather depend on the time of day that your order arrives and the amount of orders in the dispatch queue at the time. In 90% of cases you will receive your goods the next working day if you place your order before 2pm, and hopefully all orders should be received within two working days.

7. Packing
The Goods are to be properly packed and secured in such manner as to reach their destination in good condition under the normal carriage conditions of the Seller’s transportation.

8. Returns Policy

  • If you are not completely satisfied with your purchase, simply return the item to us in its original condition within 14 days of receipt.

  • Returned items should be unused and must be returned in original packaging with any enclosed documentation. We will issue a full refund on receipt, excluding the original delivery charge. Alternatively, if preferred, we will exchange the item.

  • Please note:

  1. Goods will only be accepted for return if they are despatched within 14 days of delivery, unless we have notified you otherwise.

  2. The item is your responsibility until it reaches us. Therefore for your own protection we recommend that you send the parcel using a delivery service that insures you for the value of the goods.

  3. The cost of returning the item to us is your responsibility.

  4. Delivery charges are only refundable where goods are faulty and a refund is made.

  5. There will be a 15% deducted from you refund for re-stocking fees.

    9. Damage
    The Seller does not accept responsibility for any damage, shortage, or loss in transit unless any such damage, shortage or loss in transit is notified to the Seller, by email, within 3 days of the date of dispatch.  All claims for non-delivery must be notified to the Seller, by email, within 10 days of the date of dispatch. All other claims must be notified to the Seller, by email, within 30 days of receipt of the Goods. In the absence of such emailed notification of claims, within the periods aforementioned, the goods shall be deemed to have been delivered in accordance with the Contract.

    10. Warranty and Defects
    All Goods supplied by the Seller are new and covered by a manufacturer’s warranty.
    The invoice value of any goods supplied by the Seller and subsequently agreed by the Seller to be defective in design, materials or workmanship will be replaced or credited to the Buyer.
    All warranty periods commence with the date of supply. The aforementioned warranties do not apply to defects in goods or damage to the goods caused by misuse, faulty workmanship, operation beyond the limits of rated capacity, or neglect or default in the use or application of the goods.

    11. Consequential Loss

    Notwithstanding anything contained herein the Seller shall not be liable, under any circumstances, for loss of profit, use of goodwill for delays in delivery, any direct or indirect consequential loss of any kind whether caused by negligence or otherwise. All conditions and warranties whether expressed or implied are hereby excluded save only those which by statute may not be excluded.
